1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the website titantrucktrailer.site (the “Website”) and any vehicles, trucks, trailers, parts, accessories, goods and servicing or repair services supplied by Titan Truck & Trailer Pty Ltd (ABN 99 702 110 101), referred to in these Terms as “we”, “us” or “our”.

By using the Website, requesting a quote, placing an order, purchasing goods or engaging our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or our services.

2. Who we are

Titan Truck & Trailer Pty Ltd is an Australian proprietary company registered in Western Australia under ABN 99 702 110 101. We supply trucks and trailers, sell truck and trailer parts and accessories, and provide servicing and repair services to customers throughout Perth and regional Western Australia.

3. Quotes, estimates and pricing

• Quotations provided by us are valid for fourteen (14) days from the date of issue unless otherwise stated in writing.
• Prices are quoted in Australian dollars (AUD) and include GST unless otherwise stated.
• Service and repair estimates are approximate and may change once the vehicle has been fully inspected. We will seek your approval before carrying out any additional work that was not included in the original estimate.
• Prices for vehicles and parts are subject to change without notice. The price applicable to your order is the price confirmed by us at the time your order is accepted.

4. Orders, sales and payment

• An order is not accepted until we confirm it in writing. We reserve the right to decline any order, in whole or in part.
• We may require a deposit before an order is processed or a vehicle or part is held for you.
• Payment terms will be set out in your invoice or order confirmation. Unless other arrangements are made in writing, payment is due on or before delivery or collection.
• Ownership (title) of any goods supplied does not pass to you until we have received payment in full for those goods and any other amounts owing.
• Until title passes, you must store the goods separately, keep them identifiable as our property, and not dispose of, encumber or otherwise deal with them.
• Nothing in this clause affects your rights under the Australian Consumer Law described in clause 6.

5. Availability of vehicles, parts and goods

All vehicles, parts and goods advertised or listed are subject to availability. Vehicle listings, specifications, photographs and descriptions on the Website are indicative only and may vary from the actual vehicle. We do not guarantee that any particular vehicle, part or item of stock shown on the Website will remain available at the time of your enquiry or order.

6. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded.

7. Servicing and repair work

• By leaving a vehicle with us for servicing or repair, you authorise us to carry out the agreed work and, where reasonably necessary, road-test the vehicle.
• Any additional work or parts identified during the work will be quoted separately and will not proceed without your approval, except where urgent work is reasonably necessary to make the vehicle safe.
• Replaced parts are generally disposed of unless you request their return at the time the work is authorised.
• You must collect your vehicle promptly once we notify you that work is complete. Storage fees may apply to vehicles left with us for more than seven (7) days after completion, unless other arrangements are agreed in writing.
• While we take all due care, we are not responsible for personal items left in vehicles.

8. Delivery, collection and risk

Risk in goods passes to you on delivery, collection or the first attempt at delivery, whichever occurs first. Delivery timeframes are estimates only. We are not liable for delays caused by suppliers, freight carriers or circumstances beyond our reasonable control.

9. Returns, refunds and remedies

If goods you purchase from us fail to comply with a consumer guarantee under the Australian Consumer Law, you may be entitled to a remedy, including repair, replacement or refund, depending on the nature of the failure. Please contact us with your proof of purchase and details of the issue and we will work with you to resolve the matter promptly in accordance with our obligations.

Returns for change of mind on parts and accessories may be accepted at our discretion, provided the goods are unused, in original packaging and accompanied by proof of purchase. Vehicles are sold subject to the terms of the individual sale contract.

10. Limitation of liability

To the maximum extent permitted by law, and except as set out in these Terms or required by the Australian Consumer Law, we exclude all liability for indirect, incidental, special or consequential loss or damage, loss of profits, loss of revenue or loss of business opportunity arising from your use of the Website or our goods and services. Where liability cannot be excluded, our liability is limited, to the extent permitted by law, to the resupply of the goods or services or the cost of resupplying them.

11. Website content and accuracy

Content on the Website is provided for general information only. While we take reasonable care to ensure the information, pricing and specifications published are accurate and current, errors and omissions may occur. Images are for illustration purposes and may include optional features or accessories not included in the advertised price. We recommend confirming all details with us before making a purchase decision.

12. Intellectual property

All text, graphics, logos, images and design elements on the Website are owned by or licensed to Titan Truck & Trailer Pty Ltd and are protected by Australian and international copyright and trade mark laws. You may not reproduce, distribute or use any content from the Website without our prior written consent.

13. Third-party links

The Website may contain links to third-party websites. These links are provided for convenience only. We do not endorse and are not responsible for the content, products or services of any third-party website.

14. Privacy

We handle your personal information in accordance with our Privacy Policy. By using the Website or engaging our services, you consent to the collection, use and disclosure of your personal information as described in that policy.

15. Governing law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.

We may update these Terms from time to time by publishing a revised version on the Website. The revised Terms take effect from the date of publication. It is your responsibility to review this page periodically for changes.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force.
